Floatograph is a direct seller of its products. We have customers who are value-added resellers, but no retailers or distributors.
Payment
United States and Canada:
50% of the total cost is required at time of order and the balance within 30 days of order.
US and Canadian bank-based credit cards, Visa & Mastercard accepted for an additional 2.8% Fee payable at time of order.
Government Purchase Order/Contract/Awards accepted.
Credit terms may be offered to US based customers in Floatograph’s sole discretion.
Overseas Shipments:
100% of the total cost payable via bank wire transfer at time of order, no exceptions.
Refunds/Returns
All Floatograph products are custom-built to order to the customer’s specifications. Once an order has been placed, any changes to specifications are subject to Floatograph’s prior approval in its sole discretion and may result in changes to the purchase price or delivery time. There are no refunds or returns for ordered products. Customers remain liable for full payment for any canceled orders. Please refer to Floatograph’s limited warranty below in the event of product issues.

Shipping
Floatograph utilizes a freight broker to find cost-effective methods of shipment to the customer from several approved trucking companies (Roadway, etc). You may opt to use your own freight account, however, by providing notice to Floatograph prior to shipping. Risk of loss passes to the customer on delivery to the shipping company.
Warranty
Floatograph products carry a 1-year limited material and workmanship warranty. For a period of one (1) year after delivery, Floatograph warrants that its products shall be free, under normal use and service, from defects in material and workmanship. As the customer’s sole remedy in the event of such defects, Floatograph will, in its sole discretion, either repair or replace the affected product.
The customer must provide written notice of the specific issue(s) to Floatograph and return the product to Floatograph within the 1-year period to be eligible under this warranty. Email for an RMA # prior to shipping back to the factory (Indiana, 46928). Floatograph does not pay freight to or from the factory.
Floatograph has no obligation under this warranty if a customer fails to store, operate or maintain the products in accordance with Floatograph’s directions, or if the product is altered, serviced or repaired by anyone other than Floatograph. Removal of any label on our
products voids its warranty.
FLOATOGRAPH MAKES NO FURTHER WARRANTIES, AND DISCLAIMS ANY AND ALL OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED, WITH RESPECT TO THE PRODUCTS AND SERVICES OFFERED BY FLOATOGRAPH, INCLUDING, WITHOUT LIMITATION, TITLE, MERCHANTABILITY, COMMERICAL UTILITY, FITNESS FOR ANY PARTICULAR PURPOSE, OR THAT THE PRODUCTS WILL NOT INFRINGE ANY INTELLECTUAL PROPERTY RIGHTS. FLOATOGRAPH SHALL NOT BE LIABLE FOR ANY PERSONAL INJURY OR DEATH WHICH MAY ARISE IN THE COURSE OF, OR AS A RESULT OF, THE INSTALLATION OF OR THE PERSONAL, COMMERCIAL, OR INDUSTRIAL USE OF THE PRODUCTS.
Other Terms
Floatograph shall not be liable for loss or damage resulting from any delay or failure to perform its obligations due to conditions or circumstances which are beyond its reasonable control, including: acts of God; war; acts of a public enemy; riot; civil commotion, sabotage; Federal, state or municipal action, inaction or regulation; strikes or other labor troubles; fire; flood; accidents; epidemics; quarantine restrictions; embargoes; damage to or destruction in whole or in part of office or manufacturing facilities; and inability to obtain raw material, labor, fuel or supplies.
To the fullest extent permitted by Law, the customer shall be responsible for and shall indemnify, and shall defend and save Floatograph, its affiliates and their respective employees, trustees, shareholders, officers, and directors, as well as their respective agents and consultants harmless from and against any and all costs and expenses (including all costs and expenses of litigation, as well as related attorneys’ fees), losses, liabilities, fines, penalties, damages, claims, demands, judgments, awards, obligations, actions, or proceedings arising from the acts or omissions of such customer, including its use of products provided by Floatograph, except to the extent of Floatograph’s negligence or willful misconduct.
FLOATOGRAPH’S MAXIMUM LIABILITY TO CUSTOMER WHETHER BASED UPON BREACH OF ANY EXPRESS OR IMPLIED WARRANTY, TORT, AGREEMENT, STRICT LIABILITY, OR OTHERWISE SHALL BE THE SUM OF (i) FOR WARRANTY OBLIGATIONS, THE REMEDIES DESCRIBED ABOVE, AND (ii) FOR ANY ADDITIONAL DIRECT DAMAGES, AN AMOUNT NO GREATER THAN THE TOTAL AMOUNT PAID BY SUCH CUSTOMER TO FLOATOGRAPH. FLOATOGRAPH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES.
These terms may only be modified with Floatograph’s prior written agreement, which may be withheld in its sole discretion.
